Fog lights are erquired to go off when main beam is selected.Fog lights are supposed to be used in a dipped headlight situation as main beam will reduced your range of vision. Therefore it stands to reason that if you are driving in conditions which will allow you to use main beam then it is not unreasonable to suggest that you no longer require your fog lights.I think your MOT inspector is a bit of a James Hunt who needs to review his knowledge of The Road Vehicle Lighting Regulations 1989 which, to paraphrase, states that Fog Lights are only to work when the Headlights are in the Dipped position .
